Terms governing access to and use of Create Your Anime

These Terms of Service ("Terms") are a legal agreement between you and Shengjin Digital LLC ("Shengjin Digital," "Create Your Anime," "we," "us," or "our"). They govern your access to and use of Create Your Anime, including our website, studio tools, AI generation features, account services, subscriptions, credits, downloads, and support channels (the "Service").
By creating an account, purchasing a plan or credits, clicking to accept these Terms, or using the Service, you agree to these Terms. If you use the Service on behalf of a company, team, or other organization, you confirm that you have authority to bind that organization to these Terms.
You must be at least 13 years old to use the Service. If the law where you live requires a higher age to use online services or make purchases, that higher age applies. If you are under the age of majority where you live, you may use the Service only with permission from a parent or legal guardian.
You may not use the Service if you are barred under applicable law, sanctions, export controls, or platform rules.
You must provide accurate account information and keep your login credentials secure. You are responsible for activity under your account, including projects, prompts, uploads, purchases, downloads, generated assets, and communications. Tell us promptly if you believe your account or payment method has been used without authorization.
We may require email verification, abuse checks, payment checks, moderation checks, or other reasonable controls before enabling or continuing access to parts of the Service.
Create Your Anime helps users plan stories, characters, scenes, images, and videos with AI systems. You are responsible for the prompts, uploads, references, project data, and other materials you submit ("User Content"), and for reviewing generated results before publishing, sharing, or using them commercially.
You retain your rights in User Content. Subject to your compliance with these Terms and payment obligations, Shengjin Digital assigns to you the rights we have in outputs generated for you by the Service ("Generated Content"), to the extent permitted by applicable law and the rights of our providers.
AI output can be unpredictable. Generated Content may contain errors, artifacts, unwanted similarities to third-party content, or material that requires additional rights clearance. We do not guarantee that Generated Content is unique, copyrightable, non-infringing, accurate, suitable for a particular use, or accepted by any platform, advertiser, publisher, marketplace, or rights holder.
You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, reproduce, display, adapt, and modify User Content and Generated Content as needed to operate, secure, support, moderate, improve, and troubleshoot the Service. We may process content through third-party AI, moderation, storage, payment, analytics, email, hosting, and infrastructure providers.
You must use the Service in line with our Acceptable Use Policy. You may not use the Service to:
We may block prompts, uploads, generations, downloads, accounts, payments, or support requests that appear to violate these Terms or create operational, legal, safety, provider, payment, or platform risk.
Create Your Anime uses access controls, login requirements, credit limits, rate limits, prompt moderation, including Creem Moderation API where applicable, provider safeguards, payment-risk checks, generation metadata, and abuse monitoring to reduce misuse. These controls may block a prompt before generation, stop a generation in progress, prevent downloads, restrict account features, refuse checkout, hold payment-related access for review, or require support review when safety or payment signals create risk.
Moderation and enforcement decisions may rely on automated systems, provider callbacks, user reports, support evidence, and manual review. If we believe your use violates these Terms, our Acceptable Use Policy, provider policies, payment-network rules, or applicable law, we may warn you, require changes, remove or disable access to content, suspend or terminate accounts, reverse credits, refuse abusive refund requests, restrict purchases, preserve records needed for investigation, and report unlawful or child-safety-related conduct where required or permitted by law.
Paid plans, credit packs, taxes, renewal terms, usage limits, supported generation models, and feature availability are shown at checkout or in the Service. Prices and features may change prospectively.
Subscriptions renew automatically unless canceled according to the checkout provider's flow or the account settings available in the Service. Canceling a subscription stops future renewals; it does not automatically refund amounts already paid unless required by law or expressly stated at checkout.
Credits are a metered digital entitlement for eligible generation features. Credits may expire, may be limited by plan, and are not cash, stored value, gift cards, or transferable property. We may correct credit balances affected by errors, failed generations, refunds, chargebacks, abuse, provider callbacks, or manual support adjustments.
You are responsible for taxes, duties, currency conversion fees, bank fees, and payment-provider fees that apply to your purchase unless the checkout page states otherwise.
Our Refund Policy is incorporated into these Terms. Paid subscription plans may be eligible for a refund only if the request is submitted within 24 hours after purchase or renewal and no more than 50 credits have been used from the account after that purchase or renewal.
Top-up credit packs, supplemental credits, promotional credits, bonus credits, and other separately purchased credit packages are not refundable.
If a generation fails because of a Service-side or provider-side error, we may restore the consumed credits, provide a retry, or offer another reasonable remedy. Credit restoration for failed generations is separate from payment refunds.
Nothing in these Terms or the Refund Policy limits any non-waivable consumer rights that apply in your jurisdiction.
The Service may store generated assets and provide preview, download, batch download, or signed-link access. We may set technical limits on asset size, retention, download frequency, and availability. You are responsible for keeping your own copies of materials you need long term.
The Service relies on third-party providers for authentication, AI generation, moderation, storage, payments, email, analytics, hosting, security, and other infrastructure. Your use of those features may be subject to provider terms, privacy notices, availability, pricing, and technical limits. We are not responsible for third-party services, provider outages, model behavior, payment-provider decisions, or external platform requirements.
Create Your Anime is an independent product. Model names shown on this site or in the Service identify third-party AI model integrations available through our interface. Create Your Anime is not affiliated with, sponsored by, or endorsed by the creators, owners, or providers of those models unless we expressly say otherwise.
The Service, software, user interface, branding, documentation, workflows, templates, and other materials we provide are owned by Shengjin Digital or our licensors. These Terms do not transfer our intellectual property to you. You may not remove notices, copy protected product elements, or use our branding without permission.
If you believe content in the Service infringes your rights, contact us with enough information to identify the material, your rights, and the action requested.
You may stop using the Service at any time. We may suspend or terminate access, remove content, disable downloads, refuse transactions, or close accounts if we believe you violated these Terms, created risk for the Service or other users, failed to pay, or used the Service abusively or unlawfully.
Termination does not eliminate obligations that should reasonably survive, including payment obligations, ownership provisions, disclaimers, liability limits, governing law, and dispute terms.
The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted operation, security, accuracy, and error-free output.
To the maximum extent permitted by law, Shengjin Digital and its affiliates, providers, officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, content, business opportunities, or platform access.
Our total liability for any claim related to the Service will not exceed the amount you paid to Shengjin Digital for the Service giving rise to the claim during the three months before the event that caused the claim, or USD $100 if you did not pay for the Service.
Some jurisdictions do not allow certain disclaimers or liability limits. In those jurisdictions, the limits apply only to the maximum extent permitted by law.
These Terms are governed by the laws of the United States and the laws of the U.S. state where Shengjin Digital LLC is organized, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Before filing a claim, you agree to contact us and try to resolve the dispute informally. If a dispute cannot be resolved informally, the state and federal courts located in the state where Shengjin Digital LLC is organized will have exclusive jurisdiction, except that either party may bring an eligible claim in small claims court.
You and Shengjin Digital agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, consolidated, or representative action, to the extent permitted by law.
If mandatory local consumer, privacy, or digital-service laws apply to you, nothing in these Terms limits rights that cannot be waived by contract. If any provision is unenforceable in your jurisdiction, it will be limited or modified only as much as necessary, and the rest of the Terms will remain in effect.
You are responsible for ensuring that your use of Generated Content complies with local laws, platform rules, advertising standards, intellectual property rules, and disclosure requirements that apply to your use case.
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use of the Service after changes become effective means you accept the updated Terms.
